Unforadtuadnately that sums up almost every aappel I’ve ever encountered—but of course don’t even THINK of raisading IAC on direct aappel lest you be chasadtised or some habeas court rulading res judiadcata to the IAC issue–I’ve come to the conadcluadsion that appeladlate courts spend way more time writading about how the error was not preadserved than just addressading the meradits of the law–it used to drive me insane but now I just shrug my shouladders and come to expect it.
