The law (at least in Texas) is that you have to carry proof of insurance and your linsece with you at all times while you drive. It's up to the police officer, but he's within his rights to either give you a warning, ticket you, or arrest you. If you get a ticket, it would be dismissed, but only after you go to court, show proof to the court, and pay court costs.
