It's more about the fact that they botnetted 20,000 computers without the owners consent, then changed the wallpaper without the owners consent that makes them so, in the eyes of the law. I know the story highlights that they spammed their own email addresses and crashed a website with prior permission, and this doesn't quite make it right but it does make people sit up and take notice that their PCs are not protected at all. I did a little research, it's not hard to set up a small bot net with information and associated basic scripts that you can download from the net at various dubious sites. So, the lesson is to ensure you have the best security for your PC, and an SPI firewall wouldn't go astray. You can look up SPI Firewalls on Wikipedia.
